By installing, opening, or using BRUTL, you agree to be bound by these terms. If you do not agree, do not use the app.
What BRUTL is — and isn't
BRUTL is a motivational app for entertainment purposes. It generates unpredictable bodyweight movement sequences as a creative prompt to encourage physical activity. BRUTL is not a fitness program, a training plan, medical advice, supervised exercise instruction, or a substitute for a qualified personal trainer, physician, physiotherapist, or other certified health professional. The exercises suggested by BRUTL are not designed, reviewed, or endorsed by certified trainers, doctors, physiotherapists, or any other licensed health or fitness professionals. The selection, ordering, intensity, repetitions, and timing of movements are produced by software for entertainment and motivational purposes only. You are solely responsible for deciding whether to perform any movement that BRUTL suggests, how to perform it, and when to stop.
No medical advice — consult a professional first
BRUTL does not provide medical advice. You should consult a qualified physician or other licensed health professional before beginning any exercise activity, especially if you have or have ever had a heart condition, high blood pressure, joint or musculoskeletal injury, chronic illness, or any other medical condition; if you are pregnant or have recently given birth; if you are recovering from surgery or illness; if you take prescription medication; or if you experience pain, dizziness, shortness of breath, chest discomfort, or any other unusual symptoms during physical activity. If you feel unwell at any time during a workout, stop immediately and seek medical attention if needed. The GIVE UP button is available throughout every workout — use it.
Assumption of risk
Physical activity carries inherent risks, including but not limited to: musculoskeletal injury, joint strain, falls, cardiovascular events, dehydration, exhaustion, exacerbation of pre-existing conditions, and in rare cases serious injury or death. By using BRUTL, you acknowledge and voluntarily accept all such risks. You agree to perform any movement only at a level appropriate to your current physical condition, fitness level, environment, and equipment. You agree to immediately stop any movement that causes pain or feels unsafe.
Eligibility
You must be at least 16 years old to use BRUTL. If you are between 16 and 18, you confirm that a parent or legal guardian has reviewed and accepted these terms on your behalf. BRUTL is not designed for children under 16.
Disclaimer of warranties
BRUTL is provided AS IS and AS AVAILABLE without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, Exosphere disclaims all warranties including but not limited to merchantability and fitness for a particular purpose; non-infringement; accuracy, reliability, or completeness of any content, suggestion, or instruction in the app; that the app will be uninterrupted, error-free, or secure; or that any exercise suggested by the app is safe, appropriate, or effective for any individual user.
Limitation of liability
To the maximum extent permitted by applicable law, Exosphere, its operators, contributors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages — including personal injury, illness, disability, or death; pain, soreness, strain, or any other physical or psychological harm; damage to property; loss of data, profits, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, BRUTL. To the extent any liability cannot lawfully be excluded, Exosphere's total aggregate liability to you for all claims arising out of or relating to BRUTL is limited to the greater of (a) the amount you have paid to use BRUTL in the twelve months preceding the claim, or (b) ten Euros (€10). For most users this amount is zero. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions the above limitations apply only to the maximum extent permitted by local law.
Indemnification
You agree to defend, indemnify, and hold harmless Exosphere, its operators, contributors, and affiliates from any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or related to your use or misuse of BRUTL; your violation of these terms; or any injury or damage to yourself or any third party caused by your use of BRUTL.
Intellectual property
BRUTL, its name, its visual identity, its content, and the BRUTL Manifesto are owned by Exosphere. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the app, except as expressly permitted by applicable law.
Privacy
Your privacy is covered by the separate Privacy Policy, available at brutl.win/privacy. Using BRUTL constitutes acceptance of that policy.
Changes to the app and the terms
Exosphere may modify, suspend, or discontinue BRUTL (in whole or in part) at any time without notice. Exosphere may also update these terms from time to time. Continued use of BRUTL after a material change constitutes acceptance of the updated terms.
Termination
You may stop using BRUTL at any time by uninstalling it. Exosphere may terminate or restrict your access to BRUTL at any time, with or without cause and with or without notice.
Governing law
These terms are governed by the laws of Denmark, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these terms or your use of BRUTL shall be subject to the exclusive jurisdiction of the courts of Denmark, unless mandatory consumer-protection law in your country of residence provides otherwise. If you are a consumer in the European Union, this clause does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence.
Severability
If any provision of these terms is held to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire agreement
These terms, together with the Privacy Policy, constitute the entire agreement between you and Exosphere regarding BRUTL and supersede all prior agreements.
